Protecting yourself form networks overcharge

We have just turned down one of the networks due to their T&C.

Basically they make a merchant liable for affiliate commission on charge backs and consumer fraud. That doesn't sound to me like fair terms - even affiliates themselves can act as consumers, do some tricks and then make ask pay them commissions.

I know some networks do them, some don't.

Question 1.
Could you please advise which large networks DON't have the same clause in T&C?

Question 2.
How to prevent this situation from happening with those that do?
